These Terms of Service ("Terms") govern your purchase and use of products through our Instagram page, website (when launched), or any other official FOMO PH channel (collectively, our "Page"). By placing an order or otherwise using our Page, you agree to these Terms.

1. About FOMO PH

FOMO PH sells handpainted, acrylic-on-canvas wall art designed for the Filipino condo generation. Our pieces are produced in limited runs (a maximum number of pieces per design, hand-numbered on the back), which means availability is limited and designs may sell out or be discontinued at any time.

2. Products and Availability

All items are handpainted, so slight variations in brushwork, texture, and color are normal and part of the handmade character of each piece — not defects.
Photos are taken to represent each piece as accurately as possible, but actual colors may vary slightly depending on your screen settings and lighting.
We sell in limited quantities per design. Once a design sells out, it may not be restocked, or may return later as a new edition/run.
We reserve the right to limit order quantities per customer, especially during drops or promotions.

3. Orders and Payment

Orders are placed via Instagram DM or our website (once live).
For manual GCash payments, a screenshot of your payment must be sent to us as proof of payment. An order is only confirmed once this proof of payment has been received and verified by us.
We reserve the right to cancel or refuse an order — for example, if stock runs out, payment cannot be verified, or we suspect fraudulent activity. If this happens, you'll be notified and refunded in full for any payment made.
Prices are listed in Philippine Peso (₱) and may change without prior notice. The price at the time you place a confirmed order is the price that applies to that order.

4. Shipping and Delivery

Orders may be delivered through our own in-house delivery team or through a third-party courier, depending on your location and what's available at the time.
Unless stated otherwise, delivery/shipping fees are shouldered by the buyer.
Estimated delivery timelines are provided in good faith but are not guaranteed, as they depend on delivery logistics and factors outside our control (traffic, weather, delivery delays, etc.).
Please make sure your delivery address and contact details are accurate and complete. FOMO PH is not responsible for delays or failed deliveries caused by incorrect or incomplete address/contact information provided by the buyer.
Risk of loss or damage passes to you once the item has been handed over to the courier, except where the damage is due to our packaging error (see Section 5).

5. Damages, Returns, and Refunds

Because these are handmade, limited-run pieces, we do not offer returns or refunds for change of mind.

We will offer a replacement, store credit, or refund (at our discretion) if:

The item arrives damaged in transit due to a packaging issue on our end, or
You received the wrong item from what you ordered

To claim this, please contact us within 48 hours of receiving your order, with clear photos/videos of the item and packaging as received. Claims made after this window, or without sufficient proof, may not be honored.

6. Intellectual Property

All designs, artwork, branding, photos, and content on our Page are the property of FOMO PH and may not be reproduced, copied, resold, or used commercially without our written permission.
Purchasing a piece gives you ownership of that physical artwork for personal display — it does not transfer any copyright, reproduction rights, or rights to the underlying design.

7. User Conduct

When interacting with our Page (comments, DMs, reviews, etc.), you agree not to:

Post abusive, harassing, or fraudulent content
Attempt to resell counterfeit or unauthorized reproductions of our designs as genuine FOMO PH pieces
Use our Page for any unlawful purpose

We reserve the right to block, report, or refuse service to anyone who violates these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, FOMO PH is not liable for any indirect, incidental, or consequential damages arising from your purchase or use of our products, beyond the value of the item(s) purchased. Nothing in these Terms limits any rights you have that cannot be excluded under Philippine law, including the Consumer Act of the Philippines (RA 7394).

9. Changes to These Terms

We may update these Terms as FOMO PH grows (for example, when our website launches or our policies change). Updates will be posted here with a new "Last updated" date. Continued use of our Page or placing an order after changes means you accept the updated Terms.
